Welcome to Arise. These Terms of Service ("Terms") govern your use of the Arise mobile application (the "App") operated by Julon Derivatives, LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Account Registration

To access certain features of the App, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Use of the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You agree not to:

  • Copy, modify, or distribute the App or any content within it
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the integrity or performance of the App
  • Use automated systems or software to access the App without permission

Intellectual Property

The App and its original content, features, and functionality are owned by Julon Derivatives, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

You retain ownership of any content you create or submit through the App, including voice recordings and intentions. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process such content solely for the purpose of providing and improving the App's services.

Subscription and Payments

Some features of the App may require a paid subscription. If you purchase a subscription:

  • Payment will be charged to your chosen payment method at confirmation of purchase
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You can manage and cancel subscriptions through your device's app store settings
  • Refunds are handled according to the policies of the applicable app store

Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that:

  • The App will function uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected

The App is designed to assist with morning routines and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers with any questions you may have.

Limitation of Liability

To the maximum extent permitted by law, Julon Derivatives, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or other harmful code that may be transmitted through the App

Indemnification

You agree to indemnify, defend, and hold harmless Julon Derivatives, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. You may also delete your account at any time through the App settings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the United States.
